Conference report New Postal Law and Implementing Acts 2013
On the anniversary of the adoption of the new Postal Law, on November 26, 2013, in Warsaw, the conference “NEW POSTAL LAW AND IMPLEMENTING REGULATIONS” took place.
The conference was attended by over 50 participants representing 24 institutions and companies from the postal, courier, direct marketing, technology, and consulting sectors.
The conference was devoted to assessing the first year of the Postal Law’s implementation, discussing draft implementing regulations, and analyzing practical and contentious aspects of postal and courier operators’ activities in relation to postal law, competition law, public procurement law, and tax law.
During the conference, for the first time, the Ministry of Administration and Digitization presented draft implementing acts for the Postal Law, covering such issues as:
- Registration entry
- Competition for the designated operator
- Postal service complaints
- Activity reports
- Net cost of providing universal service
- Provision of the universal service
- Regulatory accounting
- Price Cap
- Posting boxes
- Delivery boxes
In the first part of the conference, an assessment of the first year of the Postal Law’s operation was presented by: Ms. Elżbieta Pańczyk (Minister’s Legal Advisor at the Ministry of Administration and Digitization), MP Mr. Jacek Tomczak (Member of the Infrastructure Committee of the Polish Parliament and Chairman of the Parliamentary Subcommittee on Postal Law), Ms. Alina Kępczyńska (Director of the Legal Regulations Office at Poczta Polska), and Dr. Rafał Zgorzelski (President of the Management Board of the National Association of Non-Public Postal Operators, representing, among others, InPost, Polska Grupa Pocztowa, and Speedmail).
In the second part of the conference, lawyers from law firms servicing leading postal operators discussed and analyzed the regulatory and legal conditions of postal and courier activities under postal law, competition law, public procurement law, and tax law.
The discussed topics included, among others:
- Liability of operators for provided services
- Access to the postal infrastructure of the designated operator
- Rules for delivering so-called official correspondence and their relation to public procurement law
- Postal money orders and official mailing confirmations
- The designated operator and principles of providing universal services
- Competition law and the postal and courier market
- Net cost and financing of the universal service
