Conference report New postal law 2014

This year’s edition was devoted primarily to the issue of the competition for the designated operator responsible for providing the universal postal service, as well as the new model of universal service in the era of modernization and digitalization of postal services.

By the end of 2014, the Office of Electronic Communications (UKE) was to announce and define the conditions of the competition for the designated operator. The competition was to be resolved in 2015 so that the new designated operator could begin providing universal postal services on January 1, 2016. The outcome of this competition would determine the shape of the postal services market in Poland for the next decade.

During the “New Postal Law” conference, Deputy President of UKE, Mr. Karol Krzywicki, presented the draft assumptions and timeline of the competition. Afterwards, the first public debate was held regarding the conditions of the competition and the criteria for selecting the designated operator. Representatives of the operators participating in the competition — Poczta Polska S.A. and InPost Sp. z o.o. — as well as representatives of industry organizations such as the Polish Marketing Association (SMB), the National Association of Non-Public Postal Operators (OZNOP), and the Warsaw Postal Institute, presented their proposals. The debate also included representatives from UKE and the Ministry of Administration and Digitization.

The proposals submitted during the debate were to be taken into account in the competition specifications.

At the ERGP (European Regulators Group for Postal Services) forum and within the European Commission, discussions were held on the model, structure, and scope of the universal postal service in the age of modern technologies (multiple channels of interpersonal and B2B communication) and postal service digitalization.

One of the key postulates is greater flexibility in shaping the Universal Service Obligation (USO) at the national level. In response to these calls, the conference hosted a debate on the new model of universal service in Poland, with the participation of representatives from UKE, the Ministry of Administration and Digitization, Poczta Polska, InPost, OZNOP, the Polish Marketing Association (SMB), and industry experts.

In the following part of the conference, invited experts — representatives of leading law firms — analyzed specific legal issues concerning the functioning of the modern postal and courier market. These included topics such as:
