Conference report New gas market model 2012

The conference was attended by 60 participants representing 27 companies from the gas, fuel, energy, chemical, and consulting sectors from Poland, the Czech Republic, and France.

The event gathered representatives of all parties involved in the process of creating a free gas market in Poland: the Energy Regulatory Office (URE), the Polish Power Exchange (TGE S.A.), PGNiG S.A., alternative gas suppliers, and major industrial gas consumers from the chemical, energy, and fuel sectors.

In the opening address, Mr. Arkadiusz Ratajczak, Deputy Director of the Department for Promoting Competition at URE, presented conclusions from the analysis of comments on the Gas Release Program submitted by market participants and the European Commission. He also proposed a two-stage timeline for launching the wholesale gas market. In the first stage, in the second half of 2012, the gas exchange was to be launched. In the second stage, an amendment to the Energy Law was expected to introduce an obligation for large market participants to sell at least 70% of the natural gas injected into the grid through the exchange (the so-called exchange obligation).

Mr. Andrzej Janiszowski, Director of the Regulatory Department at PGNiG S.A., presented the current progress on the Gas Market Liberalization Program and the anticipated effects of liberalization for the market.

Attorney Ms. Małgorzata Banasik, co-author of the new Transmission Network Code (IRiESP), presented the main assumptions of the new Gas-System S.A. Transmission Network Operation and Maintenance Manual and discussed the framework agreement – a new model of the transmission contract.

Attorney Mr. Kamil Iwicki from the law firm GWJ Gramza, Wawrzynowicz, Jenerowicz discussed the legal conditions for gas trading at the virtual point.

Representatives of the Polish Power Exchange (TGE S.A.) and the Commodity Clearing House (IRGiT S.A.) explained the rules for natural gas trading and transaction settlements on the commodity exchange.

Mr. Grzegorz Kaczor from Ernst & Young analyzed the benefits and risks arising from the concept of gas market liberalization through the exchange mechanism.

Mr. Krzysztof Noga, President of the Management Board of KRI Marketing and Trading S.A., presented the postulates of alternative operators regarding the gas market liberalization program.

Attorney Ms. Katarzyna Radzewicz from Domański Zakrzewski Palinka law firm discussed gas market liberalization instruments included in the draft Gas Law and the information obligations resulting from the REMIT regulation.

Attorney Mr. Adam Wawrzynowicz, Managing Partner at the GWJ Gramza Wawrzynowicz Jenerowicz law firm, discussed the issue of introducing energy units for accounting and measuring natural gas trading and consumption.
